Agreement to these terms

These terms govern your use of avadshamarcreative.com, operated by Avad Shamar Creative, the creative strategy division of Avad Shamar Co.. Using the site means you accept them, together with our privacy policy. If you don't accept them, don't use the site.

Using the site

You agree not to:

• Interfere with the site's operation or attempt to probe, bypass, or test its security.
• Harvest content or data by automated means at disruptive volume, or republish scraped content.
• Misrepresent who you are in the intake, contact form, or scheduler.
• Use anything on this site to pass our work off as your own.

Content and intellectual property

The text, design, graphics, and the Avad Shamar Creative wordmark belong to Avad Shamar Co. or are used with permission. Client work shown on this site appears with the client's permission, and client names and marks remain the property of those clients.

You're welcome to quote briefly from our pages and articles with attribution and a link. Republishing a page or article wholesale requires our written permission first.

Inquiries are not engagements

Submitting the intake, writing to us, or booking a strategy conversation starts a conversation. It doesn't create a client relationship. Engagements begin only when both sides sign a written agreement, and that agreement (its scope, fees, confidentiality, and intellectual-property terms) governs the work, including over these terms if they conflict.

We read everything you send and treat it with care. Even so, until an agreement is in place, don't send anything that needs contractual protection.

Third-party tools

Some things you'll use from this site, like the scheduler behind our booking link, are run by third parties under their own terms and privacy policies. Today those are our client portal at clients.brndmee.com, Formspree for forms and The Notes, and Stripe for Lagniappe payments.

The site is provided as-is

We work hard to keep this site accurate and available, but we can't promise it will always be uninterrupted or error-free. To the fullest extent permitted by law, we aren't liable for indirect or consequential damages arising from your use of the site.

Lagniappe purchases

The Lagniappe menu sells fixed-scope services at published prices in US dollars. These terms apply to every purchase made there.

• What you are buying. Exactly what the item card lists under “What’s included,” plus the extra named on the card. Anything beyond that is a separate conversation, and we will say so before starting it.
• Payment. Handled by Stripe on Stripe’s pages, by card or US bank transfer at the same price. Bank transfers take two to five business days to clear, and delivery of final files waits on cleared funds. If you choose “Request an invoice,” we send a secure payment link within one business day and schedule the work once it is paid.
• Scheduling and timelines. We send the next step within one business day of payment. Each item’s timeline starts when we have what we need from you: the session held, the files received, the intake returned.
• Refunds. Full refund on request at any time before work begins or a session is held. Once a session has taken place or deliverable work has started, the fee is earned. If something has gone wrong, write to us and we will make it right.
• Rescheduling. Sessions may be rescheduled once at no charge with at least 24 hours’ notice.
• Credits toward larger work. The Strategic Intensive fee is credited in full toward a core engagement signed within 90 days. Other items are credited when the engagement directly builds on the work, confirmed in writing before you sign.
• Taxes. Prices exclude any sales tax your state may require on professional services; where it applies, it is shown at checkout.
• Ownership. On full payment, you own the deliverables. We keep the right to show the work in our portfolio unless you ask us not to.

Governing law

These terms are governed by the laws of the State of Louisiana, United States. Any dispute that cannot be resolved by conversation is brought in the state or federal courts serving East Baton Rouge Parish, Louisiana.

Changes to these terms

When these terms change, we update this page and revise the effective date above. Continued use of the site after a change means you accept the updated terms.
